YOURLAND “REWARD AT PURCHASE AND AT SETTLEMENT” PROMOTION 

TERMS AND CONDITIONS 

1.The Promotion 

1.1 These terms and conditions (Terms and Conditions) apply to a promotion being offered by the Promoter. The Promoter is Yourland Management Pty Ltd ACN 151 294 852 (Promoter). 

1.2 By participating in the YourLand Promotion (Promotion), you are deemed to have read and accepted these Terms and Conditions.  If you do not agree with these Terms and Conditions, you cannot participate in the Promotion.  

1.3 The Promotion commences on 28 August 2023 at 9:00am AEST and closes on 8 October 2023 at 5:00pm AEST (Promotional Period).  

2.Eligibility 

2.1 To participate in the Promotion, you must: 

    (a) sign a contract of sale of land (in the form to be provided by the Promoter) for a selected lot of land (Contract of Sale) and pay the full deposit required under the Contract of Sale during the Promotion Period;  

    (b) complete the Benefit Selection Form prior to signing the Contract of Sale; 

    (c) comply with all terms and conditions set out in the Contract of Sale at all times prior to settlement; and  

    (d) complete settlement in accordance with the terms and conditions set out in the Contract of Sale.

2.2 Participation in the Promotion is open to individual and entity participants, participation is only available to individuals who are over 18 years of age and residents of Australia.

2.3 Unless otherwise agreed by the Promoter, a participant is not eligible to receive the Promotion Benefit on more than one Contract of Sale and the Promotion cannot be used in conjunction with any other offer or promotion being offered by the Promoter. 

3. Promotion Benefit 

3.1 If you meet the eligibility requirements set out in these Terms and Conditions, the Promoter shall provide you with two benefits, the Category A benefit and a choice of one benefit from Category B.  

3.2 If you meet the eligibility requirements set out in these Terms and Conditions, the Promoter shall provide you with the following Category A benefit:

    (a) A fixed deposit amount of $10,000.00 (subject to completing a free finance health check with Ello Lending); and

    (b) A discount of $20,000.00 off the advertised price of that lot.

3.3 If you meet the eligibility requirements set out in these Terms and Conditions, the Promoter shall also provide you with the option to choose one of the following Category B benefits:

    (a) A gift card to the value of $5,000.00 redeemable with Luxury Escapes; or

    (b) A gift card to the value of $5,000.00 redeemable with Prezzee.  

3.4 These two benefits (together the Promotion Benefit) will at all times remain subject to these Terms and Conditions.

3.5 The Category A benefit will be included in the terms of the Contract of Sale.  

3.6 A participant must select their Category B benefit by completing the Benefit Selection Form provided at the time of signing the Contract of Sale;

3.7 A participant cannot elect to change their choice of Category B benefit after completing the Benefit Selection Form;

3.8 A participant is only entitled to receive one benefit from Category B. A participant has no entitlement to, and cannot elect to receive, multiple benefits from within Category B.

3.9 To be eligible to receive the Category B benefit, Participants must notify the Promotor of the Category B benefit that the Participant has selected prior to signing the Contract of Sale.

3.10 A participant will receive their Category B benefit within 60 days of settlement of the Contract of Sale. 

3.11 Gift cards are subject to availability. The Promoter reserves the right to amend, withdraw or substitute the gift cards or any component of the gift cards in the event of any unforeseen circumstances outside its reasonable control. 

3.12 Issuers of gift cards offered under a Category B benefit have their own terms and conditions governing the use, expiry, and transferability of their gift cards. The Promoter makes no warranty as to the terms contained in the issuer’s policies.  Participants must make their own enquiries with the issuer of a gift card.  

3.13 Once a gift card is provided in accordance with clause 3.9 of these Terms and Conditions, the Promoter is not responsible for the expiration or cancellation of a gift card.

3.14 The Promotion Benefit is only available on select lots as determined by the Promotor. 

3.15 The Promotion Benefit is not redeemable for cash and shall only be applied in the manner set out in clauses 3.2 and 3.3 of these Terms.

3.16 Despite any term to the contrary, a participant who does not do all things reasonably necessary to effect settlement of the Contract of Sale on the original settlement date as defined in the Contract of Sale, will not be eligible to receive a Category B benefit.   

3.17 Despite any term to the contrary, a participant who is granted an extension to the original settlement date as defined in the Contract of Sale, will not be eligible to receive a Category B benefit.   

 4. General 

 4.1 To the extent permitted by law, the Promoter excludes all liability for any personal injury, loss or damage in any way arising as a result of receiving the Promotion Benefit or any aspect of the Promotion Benefit.

4.2 The Promoter expressly denies and excludes all representations about the gift cards, except as set out in these Terms and Conditions.

4.3 The Promoter reserves the right to vary the terms of, or cancel, the Promotion at any time without liability to any participant or other person, subject to applicable laws. The eligibility of participants to participate in the promotion is solely within the discretion of the Promoter.
